Welcome to Presence. These terms and conditions outline the rules for using the Presence platform website and related services (collectively, the "Service"), including when accessed at presenceplatform.ca.

By accessing the Service, you accept these terms. If you do not agree, please do not use Presence.

Privacy, your data, and how we operate

Presence does not sell your personal information. Details on collection, use, retention, and your rights are in our Privacy Policy, which is incorporated into these terms by reference.

We aim to run the Service ethically and in compliance with all applicable laws, regulations, and our published policies (including the Privacy Policy). You agree to use the Service lawfully and in line with these terms and those policies.

Cookies

We use cookies to personalize your experience. By using the Service, you agree to required cookies that keep the site secure and functional. Optional cookies may be used for analytics or improvements where permitted. You can control optional cookies through your browser settings where available.

License and intellectual property

Unless otherwise stated, Presence and its licensors own intellectual property rights in materials on the Service. You may access content for personal or organizational use in line with these terms. You must not copy, republish, sell, rent, sublicense, duplicate, or redistribute content from the Service except as expressly allowed.

User comments and content

Where the Service allows you to post comments or other content, Presence does not pre-screen all submissions. Views expressed are those of their authors. We may monitor and remove content that is inappropriate, unlawful, or breaches these terms.

You warrant that content you post:

  • You have the right to post it and any necessary consents;
  • It does not infringe third-party rights;
  • It is not defamatory, unlawful, or invasive of privacy;
  • It is not used for unauthorized solicitation or unlawful activity;
  • It does not violate the prohibitions on hate groups, violence, genocide, or oppression set out in Prohibited organizations and conduct below.

You grant Presence a non-exclusive license to use, reproduce, and display your content as needed to operate the Service.

Prohibited organizations and conduct

Presence is committed to operating a safe and inclusive platform. The restrictions in this section apply to all users of the Service, including individuals, community groups, and business accounts. Capitalized terms used in this section have the meanings given below.

Determination by Presence. Whether any Community Group, Business, user, content, event, or activity is hateful, violent, oppressive, affiliated with a hate group, or otherwise in violation of this section is determined by Presence Platform in its sole discretion. You acknowledge that this determination does not require a court ruling, government designation, or third-party label, and that our decision is final for purposes of access to and use of the Service. We may consider any information we deem relevant, including group names, descriptions, imagery, links, public statements, reported conduct, and patterns of activity on or off the Service where reasonably connected to use of the platform.

"Hate group" means any organization, collective, or identifiable group of persons that Presence determines, in its sole discretion, has as its primary purpose or a substantial part of whose activities the advocacy of hatred, violence, discrimination, or dehumanization directed at individuals or groups based on race, ethnicity, national origin, religion, creed, gender, gender identity or expression, sexual orientation, disability, or other characteristic protected under applicable law.

Community groups

Any person or entity that creates, administers, maintains, or represents a community group on the Service (a "Community Group") agrees that the Community Group shall not, and shall not use the Service to:

  • Operate as, identify as, or function in substance as a hate group, or permit the Community Group to be used as a forum, recruitment channel, or public face for a hate group;
  • Advocate for, glorify, incite, promote, or provide material support for violence against any person or group of persons;
  • Advocate for, deny, glorify, minimize, or provide material support for genocide, crimes against humanity, ethnic cleansing, or systematic oppression of any people or population;
  • Organize, promote, fundraise for, or publicize events or activities that further any of the conduct prohibited in this section.

Community Groups are solely responsible for the content, membership standards, and activities associated with their presence on the Service. Presence does not endorse any Community Group and reserves the right to remove any group that Presence determines, in its sole discretion, violates these terms or is hateful, violent, or otherwise prohibited under this section.

Business accounts

Any business, commercial entity, or person operating a business profile or listing on the Service (a "Business") agrees that the Business shall not, and shall not use the Service to represent, advertise, or disclose:

  • Material support for, affiliation with, or endorsement of any hate group;
  • Sponsorship of, financial backing for, or promotion of events organized by or on behalf of a hate group;
  • Donations, grants, in-kind contributions, or other transfers of value to a hate group, whether made directly or through intermediaries; or
  • Any partnership, sponsorship, or charitable activity that would constitute a violation of this section if undertaken on or through the Service.

Businesses remain solely responsible for the accuracy, completeness, and legality of all listings, partnership disclosures, and promotional content they publish. Display of a partnership or sponsorship on the Service does not constitute verification or approval by Presence.

Enforcement

We may monitor the Service, investigate reports, and take action when we obtain actual knowledge or, in our sole discretion, determine that a user, Community Group, Business, or content violates this section or any other provision of these terms. Without limiting any other remedy available to us at law or under these terms, if we determine in our sole discretion that a violation has occurred, we may immediately and without prior notice: remove or disable content; suspend or terminate accounts; delete Community Group or Business profiles; and permanently ban the responsible user(s) from the Service. Banned users may not create new accounts or circumvent a ban through third parties. We may preserve relevant information and report suspected unlawful conduct to law enforcement or other competent authorities where required or appropriate. You agree that Presence shall not be liable for actions taken in good faith to enforce this section.

Child safety standards: CSAE and CSAM (Presence)

These standards apply to Presence (the Presence mobile application as distributed on Google Play and related services under the same listing name) and to all use of the Service, including the website and the App. They describe our published standards against child sexual abuse and exploitation (CSAE) and how we address child sexual abuse material (CSAM).

Standards against CSAE. We prohibit CSAE on the Service. CSAE includes content or conduct that sexually exploits, abuses, or endangers children—for example grooming a child for sexual exploitation, sextortion of a child, trafficking of a child for sex, or other sexual exploitation of a child. You must not use the Service to engage in CSAE or to facilitate it.

CSAM. CSAM is illegal. You must not create, upload, share, solicit, store, or distribute CSAM through the Service. CSAM includes any visual depiction (including photos, videos, or computer-generated imagery) of a minor engaging in sexually explicit conduct, as understood under applicable law.

Action when we become aware. When we obtain actual knowledge of CSAM or CSAE on the Service, we take appropriate action in line with these standards and applicable law. That may include removing content, restricting or terminating accounts, preserving information where legally required, and reporting to law enforcement or other competent authorities where required or appropriate.

Compliance. We operate the Service with the aim of complying with applicable child-safety and related laws and regulations, in addition to these terms and our Privacy Policy.

Reporting and contact. You can report concerns from within the App using the in-app feedback or reporting features where available. You may also contact our child-safety point of contact at admin@presenceplatform.ca. We may ask for information reasonably needed to assess a report. Linking to our content

Government agencies, search engines, news organizations, and similar parties may link to our site where the link is not deceptive and fits the context of the linking site. Other link requests may be considered on a case-by-case basis. Use of our logo or branding for linking requires prior written agreement.

Third-party content and links

We are not responsible for content on third-party sites linked from the Service. You agree to defend us against claims arising from content you publish on your own properties that links to us in a misleading or unlawful way.

Changes and removal of links

We may ask you to remove links to our site and may amend these terms at any time. If you believe a link on our site is offensive, contact us and we will consider your request.

Disclaimer

To the maximum extent permitted by law, we exclude representations and warranties relating to the Service except where liability cannot be excluded (including for death, personal injury caused by negligence, or fraud). Where the Service is provided free of charge, we are not liable for any loss or damage of any nature, subject to applicable law.

Mobile application

Last updated: May 20, 2026. The Presence mobile application ("App") has additional terms. By downloading or using the App, you agree to those terms. A summary follows; the full mobile terms published at presenceplatform.ca/terms may apply concurrently where the App is used.

Acceptance

By installing or using the App, you agree to be bound by the App terms. If you do not agree, do not use the App.

Service description

Presence connects community groups, local businesses, and users. The App may allow you to discover and follow groups, browse businesses, view partnerships, and access community information.

Accounts

You must provide accurate information, keep credentials confidential, and notify us of unauthorized use. You must be at least 13; if under 18, you represent that you have parental or guardian permission where required.

Conduct and content

You agree to use the App lawfully. You must not violate laws, transmit abusive material, impersonate others, disrupt the App, use unauthorized automated access, or harvest data without permission. You must not engage in CSAE or upload, share, or solicit CSAM, as described in Child safety standards: CSAE and CSAM above. Community Groups and Businesses must comply with Prohibited organizations and conduct, including the prohibitions on hate groups, violence, genocide, and oppression and the obligation not to sponsor hate-group events or donate to hate groups. Whether conduct violates that section is determined by Presence Platform in its sole discretion. You retain ownership of content you post and grant us a license to operate the App. We may remove content that violates these terms and permanently ban violators as described in that section.

Listings and partnerships

Businesses and groups are responsible for the accuracy of their listings. Displayed partnerships rely on user-provided information unless explicitly marked as verified. Businesses may not list or imply sponsorship of, donations to, or support for hate groups or their events; violations may result in deletion of the profile and a permanent ban.

Intellectual property, privacy, warranties, liability

The App and its features are owned by Presence and protected by applicable laws. Your use of the App is also governed by our Privacy Policy. The App is provided "as is" without warranties to the extent permitted by law. Our total liability is limited as described in the full mobile terms where applicable.

Termination and changes

We may suspend or terminate access, delete accounts, and permanently ban users for breaches of these terms, including violations of Prohibited organizations and conduct. We may modify terms and will notify users of material changes by reasonable means.

Governing law

These terms are governed by the laws of Canada, without regard to conflict-of-law rules. Disputes may be brought in the courts of Canada, subject to mandatory consumer protections where you reside.
